Welcome to MOAMOA65 JAPAN. In these Terms, "we", "us" and "our" refer to INCLUWAY, trading as MOAMOA65 JAPAN, a business registered in Osaka, Japan. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). MOAMOA65 JAPAN is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with every policy referenced in them, set out your rights and responsibilities when you use the Services. Please read them carefully: they contain important information about your legal rights, including limitations of liability.

By visiting, using or interacting with the Services you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use or access the Services.

1. Access and account

By agreeing to these Terms you confirm that you are of legal age in your country or region of residence, and that if you allow a minor in your care to use the Services on a device you own or control, you take responsibility for that use.

To buy from us you may need to provide information such as your email address, billing, payment and shipping details. You represent that all information you give us is accurate, current and complete, and that you have the right to provide it. You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell or license your account to anyone else.

2. What we sell and how

MOAMOA65 JAPAN sells genuine Japanese products to customers outside Japan on a purchase-agency basis. We do not hold most items in stock. When you place an order, we buy the item from a Japanese retailer or the manufacturer on your behalf, and then ship it to you from Osaka.

You represent and warrant that any item you buy is for your own personal or household use and not for commercial resale.

We make every effort to represent our products accurately. Colours and appearance may differ from what you see on screen depending on your device. Manufacturers in Japan may change specifications, formulation or packaging without notice, so the item you receive may differ in minor respects from the images or description shown. Where a product description has been translated, the original Japanese text of the manufacturer prevails.

Product descriptions may change at any time without notice. We may discontinue a product at any time, and we may limit the quantity we supply to any person, region or jurisdiction.

3. Orders

Placing an order is an offer to buy. We may accept or decline any order at our discretion. An order is not accepted until we confirm it. Payment must be received and processed before an order is accepted.

You may request cancellation of an order until it is handed to Japan Post, as set out in our Refund Policy. Please check your order carefully before submitting it. If we decline, change or cancel an order, we will contact you using the email address, address or phone number you provided.

Returns and exchanges are governed solely by our Refund Policy.

4. Prices and billing

Prices, discounts and promotions may change without notice. The price charged is the price in effect when your order is accepted, as stated in your order confirmation. Prices are shown in Japanese yen unless another currency is displayed for your market.

Unless stated otherwise, posted prices exclude import duties, customs fees, value-added tax and other charges imposed by the destination country. Those are payable by you and are collected directly by the carrier or customs authority.

Prices in this store may differ from prices for the same item in Japan or in other stores. If we run a promotion, it may carry its own terms; where those conflict with these Terms, the promotion terms prevail for that promotion.

You agree to provide current, complete and accurate purchase and account information, and to update it promptly so that we can complete your transaction and contact you as needed. You represent that any payment card you use is yours to use, that the charge will be authorised by your card issuer, and that you will pay the amount charged.

5. Shipping, customs and delivery

We ship from Osaka, Japan, by Japan Post. Delivery times are carrier estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs clearance, weather or other events outside our control. Title and risk of loss pass to you when the goods are handed to the carrier.

Import rules for food, supplements, cosmetics and quasi-drugs differ in every country and usually limit the quantity that may be imported for personal use. It is your responsibility to check whether an item may lawfully be imported into your country before ordering. If you are unsure, contact us before you order and we will cancel and refund in full at any time before dispatch.

If a parcel is held, refused, destroyed or returned by customs, the terms of our International Shipping & Customs Policy apply, including who bears the resulting costs.

6. No medical or health advice

Some items we sell are classified in Japan as quasi-drugs, designated quasi-drugs, foods with function claims, or supplements. These classifications are Japanese and have not been reviewed by the regulatory authority of any other country.

Nothing on this store is medical advice, and nothing we publish is intended to diagnose, treat, cure or prevent any disease. Always read the manufacturer's instructions on the package, follow the stated dosage, and consult a doctor or pharmacist if you are unsure whether a product is suitable for you. Discontinue use and seek medical advice if you experience any adverse reaction.

7. Intellectual property

The Services, including all text, displays, images, graphics, video and audio, and their design, selection and arrangement, are owned by MOAMOA65 JAPAN, our affiliates or our licensors, and are protected by Japanese and foreign copyright, trademark and other laws.

These Terms permit you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any material on the Services without our prior written consent. Nothing in these Terms grants you any licence or right in any patent, trademark, copyright or other intellectual property of MOAMOA65 JAPAN, Shopify or any third party. All rights not expressly granted are reserved.

Product names, brand names and manufacturer logos shown on this store are the trademarks of their respective owners and are used to identify the goods offered for sale.

8. Optional tools

We may give you access to third-party tools as part of the Services which we neither monitor nor control. You acknowledge that we provide such tools "as is" and "as available", without any warranty, representation, condition or endorsement. We accept no liability arising from your use of optional tools. Your use of them is entirely at your own risk and discretion, and you should review the provider's own terms. New features and tools released in future form part of the Services and are subject to these Terms.

9. Third-party links

The Services may contain material and links to websites operated by third parties. We are not responsible for reviewing or evaluating the content or accuracy of those sites, and we accept no liability for any harm or loss connected with your use of them. Review a third party's policies and practices carefully before transacting with them. Any complaint or claim about a third party's products or services should be directed to that third party.

10. Relationship with Shopify

MOAMOA65 JAPAN is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchase transactions in our store are made directly with MOAMOA65 JAPAN. By using the Services you acknowledge and agree that Shopify is not responsible for any aspect of the sales activity between you and MOAMOA65 JAPAN, including any injury, damage or loss arising from products or services purchased. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising out of or relating to your purchases and transactions with MOAMOA65 JAPAN.

11. Privacy

Any personal information you provide through the Services is governed by our Privacy Policy, and certain personal information is also governed by Shopify's privacy policy. By using the Services you acknowledge that you have read and understood our Privacy Policy.

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services. Information you submit may be transmitted to and shared with Shopify and other parties that may be located in countries other than the one you live in.

12. Feedback

If you submit ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, sub-licensable, royalty-free licence to use, reproduce, modify, publish, distribute and display it in any medium and for any purpose, including commercially. You represent that you own or have all necessary rights in your Feedback, that you have disclosed any compensation received in connection with it, and that it complies with these Terms.

We are not obliged to keep Feedback confidential, to pay for it, or to respond to it. We may, but need not, monitor, edit or remove Feedback that is unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes the rights of others. You agree your Feedback will not infringe any third-party right and will not contain defamatory or unlawful material or any malicious code. You must not use a false email address, impersonate anyone, or mislead us about the origin of Feedback.

13. Errors, inaccuracies and omissions

The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times and availability. We reserve the right to correct any error and to change or update information, or cancel an order, at any time without prior notice, including after an order has been submitted.

14. Prohibited uses

You may access and use the Services for lawful purposes only. You may not use the Services: for any unlawful or malicious purpose; in breach of any applicable law or regulation; to infringe our intellectual property rights or those of others; to harass, abuse, defame or harm any person; to transmit false or misleading information; to send junk mail, chain letters or spam; to impersonate any person or entity; or in any way that could damage or impose liability on MOAMOA65 JAPAN, Shopify or other users.

You further agree not to: upload or transmit viruses or malicious code; reproduce, duplicate, copy, scrape, sell or exploit any part of the Services; harvest or track the personal information of others; engage in phishing or spoofing; use robots, spiders, scrapers, data-extraction tools, automated processes or AI agents to access the Services; or interfere with, circumvent or bypass any security, authentication or robot-exclusion measure we apply.

We may terminate these Terms or your use of the Services, in whole or in part, at any time and without notice, at our sole discretion. You remain liable for all amounts due up to the date of termination. Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, governing law and any other provision which by its nature should survive, will survive termination.

17. Disclaimer of warranties

Information provided through the Services is for general information only. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.

Except as expressly stated by MOAMOA65 JAPAN, the Services and all products supplied through them are provided "as is" and "as available" without representation, warranty or condition of any kind, express or implied, including any implied warranty of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement. We do not warrant that your use of the Services will be uninterrupted, timely, secure or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you.

18. Limitation of liability

To the maximum extent permitted by law, in no event will MOAMOA65 JAPAN, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors, or Shopify and its affiliates, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including loss of profits, revenue, savings or data, or replacement costs, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Services or of any product procured through the Services.

Where liability cannot lawfully be excluded, our total liability is limited to the amount you paid for the product giving rise to the claim.

19. Indemnification

You agree to indemnify, defend and hold harmless MOAMOA65 JAPAN, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any liability arising out of (1) your breach of these Terms or of any document incorporated by reference, (2) your violation of any law or of the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any claim for which indemnity is sought, though a delay in notice does not release you unless it materially prejudices you. We may control the defence and settlement of the claim with counsel of our choosing, but will not settle any claim imposing a non-monetary obligation on you without your consent, which must not be unreasonably withheld. You agree to cooperate in the defence of any indemnified claim.

If any provision of these Terms is held unlawful or unenforceable, it will be enforced to the fullest extent permitted by law, the unenforceable part will be severed, and the validity and enforceability of the remaining provisions will not be affected.

21. Waiver and entire agreement

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it. These Terms, together with any policy or operating rule we post in connection with the Services, constitute the entire agreement between you and us and supersede all prior agreements, communications and proposals, whether oral or written, including any earlier version of these Terms. Any ambiguity is not to be construed against the drafting party.

22. Assignment

You may not delegate, assign or transfer these Terms or your rights or obligations under them without our prior written consent; any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice.

23. Governing law and jurisdiction

These Terms and any separate agreement by which we provide the Services to you are governed by and construed in accordance with the laws of Japan, without regard to conflict-of-law rules. You and MOAMOA65 JAPAN agree to submit to the exclusive jurisdiction of the Osaka District Court in Japan as the court of first instance.

Nothing in this section deprives you of the protection of any mandatory consumer-protection rule of the country in which you habitually reside, where such a rule applies to you and cannot be excluded by agreement.

24. Headings

Headings are included for convenience only and do not limit or otherwise affect these Terms.

25. Changes to these Terms

The current version of these Terms is always available on this page. We may update, change or replace any part of them by posting the change on this website. It is your responsibility to check for changes. Where required by law we will notify you of material changes, which take effect on the date stated in the notice. Your continued use of the Services after a change is posted constitutes acceptance of it.
